Please read the following agreement carefully before using any of Cigs services. By using our services, you agree to be bound by the terms and conditions below. If you do not wish to be bound by these terms and conditions, please do not use our services.
1) Limitation of Liability
USER AGREES THAT CIGS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE OR FOR COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF USER'S TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF CIGS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. CIGS IS NOT RESPONSIBLE FOR ANY LOSS OF DATA OR BUSINESS RESULTING FROM SYSTEM OR NETWORK BREAKDOWN OR OUTAGE OR ANY OTHER REASON.
2) Indemnification
USER FURTHER AGREES THAT CIGS SHALL NOT BE HELD LIABLE FOR ANY DAMAGES ARISING FROM, THE INTERRUPTION, SUSPENSION OR TERMINATION OF SERVICE, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, SPECIAL CONSEQUENTIAL OR EXEMPLARY DAMAGES, WHETHER SUCH INTERRUPTION, SUSPENSION OR TERMINATION WAS JUSTIFIED OR NOT, NEGLIGENT OR INTENTIONAL, INADVERTENT OR ADVERTENT.
3) Stock
Certain brands may not be immediately available for purchase.
4) Duty Free Shopping
Only orders shipped to the U.S.A. will be Duty Free. Orders shipped to other countries: Depending on your country, Duty fees and other fees may apply and must be paid by the customer.
5) Shipping and Handling
Although we strive to get products shipped on time, we cannot guarantee delivery time. Restock time for cigarettes on backorder cannot be guaranteed. Maximum shipping time is 2 weeks for priority shipping and 5 weeks for economy shipping, both with a grace period of 5 days. Cigs is not responsible for lost or stolen packages, nor packages sent to the incorrect address as a result of customer supplying incorrect address. Cigs is not responsible for any losses incurred due to excess delivery time. Products are attempted to be delivered on time to our fullest extent, but delivery time cannot be guaranteed. Cigs reserves the right to substitute soft pack for box packs and box packs for soft.
6) Refunds
Products purchased from Cigs may in no circumstances be returned for a refund. Cigarettes purchased on backorder are eligible for a refund, minus applicable PayPal.com transaction fees and shipping fees.
7) Your Information
User is responsible for his/her password (if any), User's account and all activity under User's account and/or password. If any information provided by user is untrue, misleading, inaccurate or in any other way offensive, Cigs reserves the right to refuse any and all future use of the service by User.
8) Customer Reviews
Customer reviews are copyright of Cigs. We reserve the right to add, modify, delete or edit reviews.
9) Payment Processing
Cigs relies on PayPal.com, a third party provider of merchant credit processing services.
10) Privacy Policy
The Cigs Privacy Policy is incorporated herein by reference.
11) Copyright Notice
User agrees that content and information contained in the Cigs service is protected by proprietary rights and laws. User shall not copy, reproduce and/or distribute any content and/or information without express written authorization by Cigs.
12) We reserve the right: (i) To deny or terminate service to anyone for any or no reason. (ii) To display text and/or images throughout the service. (iii) To inform User by email of website upgrades, additional products and services offered by Cigs. (iv) Modify, change or discontinue this site and the services available without notice or liability to customer. (v) To change prices without prior notice.
